1. Eligibility
You must be 18 years of age or older to use the Service. The Service is intended for Muslim individuals seeking marriage. By joining the waitlist or creating an account, you confirm that you are 18 or older and that your use complies with the laws that apply to you.
2. What the Service is right now
The website currently offers a waitlist, product information, and optional one-time founding contributions paid via Stripe. The full Maktub application and its matching features are in development and are not yet generally available. Descriptions of planned features, timelines, and capacity are indicative and may change — they are not promises or guarantees. Joining the waitlist does not create any contract to provide the future app, nor any guarantee of access, a place in any cohort, or a specific launch date. Founding support is voluntary and governed by these Terms and our Refund Policy.
3. User accounts
When the app is available, you will need to register an account with accurate, complete information. You are responsible for:
- keeping your login credentials confidential;
- all activity that takes place under your account;
- notifying us promptly if you suspect unauthorised access.
You may not create more than one account, transfer your account to another person, or allow anyone else to use it. We reserve the right to require identity verification before granting access.
4. Your profile and content
When using the app, you may submit profile content including photos, a voice note, biographical details, and match preferences. You confirm that:
- any content you submit is accurate and belongs to you or you have the right to share it;
- photos show only yourself and do not infringe any third party’s rights or privacy;
- you are not impersonating another person.
You retain ownership of your content. You grant us a limited, non-exclusive licence to store and display it to other users as needed to operate the Service. We may remove content that violates these Terms without notice.
5. Wali Mode
The app includes a Wali Mode feature that allows you to designate a guardian (wali) to view your profile activity. By enabling Wali Mode you confirm that you have obtained the consent of the person you designate before sharing their contact details with us, and that they are aware their information will be used for this purpose.
6. Acceptable use and conduct
You must meet the eligibility rules in section 1 (including being 18 or older). You agree not to:
- provide false, misleading, or someone else’s information, including submitting another person’s email address without their knowledge or consent;
- misrepresent your identity, marital status, or intentions;
- send unsolicited, offensive, or harassing messages to other users;
- share another user’s profile information, photos, or messages with third parties without their consent;
- use the Service to commit, solicit, or facilitate any illegal activity under applicable law (including Dutch and EU law and other laws that apply to you);
- upload, display, or exchange sexually explicit profile content (including photos, voice notes, text, or links), including pornography or graphic sexual material;
- create, share, or promote content or conduct that depicts, threatens, or glorifies sexual violence or sexual exploitation;
- engage in, solicit, or facilitate child sexual exploitation or abuse (CSE/CSA), including child sexual abuse and exploitation (CSAE); create, upload, share, link to, or solicit child sexual abuse material (CSAM) or any sexual content depicting a minor under 18 (real or purported); groom or sexualise a minor; request intimate media from anyone under 18; or attempt to contact, recruit, or involve a minor through the Service (the Service is adults-only as set out in section 1; see also our Safety and Law Enforcement pages);
- share non-consensual intimate imagery or recordings (real or purported), or any sexual content of a person without their consent;
- use the Service to recruit for, advertise, arrange, or otherwise facilitate human trafficking or sex trafficking, including commercial sexual exploitation;
- engage in scam or fraud activity intended to deceive or defraud users of the Service, including deceptive schemes, romance or financial scams, phishing, impersonation to obtain money or data, soliciting money, or promoting commercial services under false pretences;
- attempt to disrupt, probe, or gain unauthorised access to the Service or its systems;
- copy, scrape, or reproduce the Service or its content without our written permission.
We may remove content, suspend or terminate accounts that violate this section, and refer matters to authorities where legally required. Suspension and termination are also described in section 14.
7. No guarantee of outcomes
Maktub is an introductions platform. We do not guarantee that you will find a match, a spouse, or any particular result. Matching features depend on other users, whose conduct and choices we do not control.
8. Payments and subscriptions
The waitlist is free. You may optionally make a one-time founding contribution via Stripe (tiers or custom amounts up to €500 per person, VAT included where applicable). Founding support is voluntary, separate from any future Maktub Plus subscription, and does not buy better matches or guaranteed cohort admission. Benefits are described at checkout.
Refunds are governed by our Refund Policy and require an email request from you (they are not issued automatically). If we permanently discontinue Maktub before the app is generally available so founding benefits cannot be used, you may request a refund of what you paid for that contribution; that refund is your remedy except for rights that cannot be limited by law. All fees we charge directly are in euros (EUR). Nothing in these Terms affects your mandatory consumer rights under Dutch and EU law.
9. Intellectual property
The Maktub name, branding, design, text, and other content on the Service are owned by us or our licensors and are protected by intellectual property laws. You may not use them without our prior written consent.
If you believe content on the Service infringes your copyright or other intellectual property rights, email info@getmaktub.app with the subject line Copyright notice. Include:
- your name and contact details;
- a description of the work you claim is infringed and where it appears on the Service (URL, profile, or other locator);
- a statement that you have a good-faith belief the use is not authorised by the rights holder, their agent, or the law;
- a statement that the information in your notice is accurate, and that you are the rights holder or authorised to act on their behalf.
We will review complete notices and may remove or disable access to the material and, where appropriate, suspend or terminate accounts. This is how we handle copyright and similar IP complaints for the Service, including notices that would be framed as DMCA notices in the United States. It does not create rights beyond applicable law, and it does not designate a US DMCA agent under 17 U.S.C. § 512.
10. Your information
Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, nor do we endorse or verify the accuracy of any user-submitted content.
12. Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under applicable law.
Subject to that, to the fullest extent permitted by law we are not liable for any indirect or consequential loss, or for any loss of profits, data, goodwill, or opportunity. Our total aggregate liability to you for all claims is limited to the greater of €100 or the total amount you paid to us in the 12 months preceding the claim.
13. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Zerophia, Maktub, and our directors, officers, employees, and agents from and against any third-party claims, demands, proceedings, damages, losses, and reasonable legal costs and expenses of defence (including lawyers’ fees) arising out of or related to:
- your use of the Service;
- content you submit (including photos, voice notes, text, and messages);
- your conduct toward other users or third parties;
- your breach of these Terms; or
- your fraud, wilful misconduct, or negligence.
This includes situations where your behaviour causes us to be sued or otherwise drawn into a dispute. We may control the defence and settlement of any claim; you will cooperate reasonably. Nothing in this section requires you to indemnify us for our own wilful misconduct or for liability that cannot be limited or allocated to you under mandatory Dutch or EU consumer law.
14. Suspension and termination
We may suspend or terminate your access if you breach these Terms, or for any other legitimate reason with reasonable notice where practicable. You may close your account or leave the waitlist at any time by contacting us at info@getmaktub.app. On termination, your data will be handled in accordance with our Privacy Policy.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we will notify you by email at the address you provided. The updated Terms will show a new “last updated” date. If you continue to use the Service after a material change takes effect, you accept the updated Terms. If you do not agree, you may leave the waitlist or close your account by contacting us.
16. Governing law
These Terms are governed by the laws of the Netherlands, and the courts of the Netherlands have jurisdiction. If you are a consumer resident in another EU member state, you also retain the benefit of any mandatory consumer protections under your local law.
